A district may not categorically exclude LEP students from programs for the gifted and talented.

  • If a district has a process for locating and identifying gifted or talented students, it must also locate and identify gifted or talented LEP students who could benefit from the program.
  • Educational justifications for excluding any LEP student from such a program should be comparable to justifications used in excluding a non-LEP student.
